Desiree van der Walt MPL DA Limpopo Spokesperson on Local Government The Municipal Manager of Blouberg Local Municipality Mr. Thoka Kgoale is back to his position despite being suspended and the Labour Court confirming this suspension. The court handed down its decision(DA is in possession of court judgment) on 26 February 2013 but Mr. Kgoale was already back to his position on 2 February 2013. The court found that council meeting of 17 August which resolved to have a precautionary suspension against the Municipal Manager was procedurally convened. Mr. Kgoale failed to make written representation to the Council why he should not have been suspended pending serious disciplinary hearing against him. His suspension was confirmed by Council on 31 October 2012. There were very serious allegations against him including his alleged failure to disclose that he was dismissed in his previous employment and others relating to financial mismanagement. He took the matter to court and his application was dismissed; he was ordered to pay the costs of the court action. He appealed against this decision and the matter is still pending. However in the meantime and without the matter being finalised, he went back to his position and is currently serving as the municipal manager of Blouberg Municipality. In this position he now has the power of attorney to decide whether the municipality will oppose the very same matter it has against him. This is an utter abuse of the court processes and is likely to lead to costs being awarded against this municipality. This would be another wasteful expenditure and is likely to lead to a negative finding by the Auditor-General. We will be urging Mr. Clifford Motsepe, MEC for Cooperative Governance, Traditional Affairs and Human Settlement to intervene in this matter by ensuring that this municipal manager remains suspended until his own court processes have been finalised.
