Midvaal Merger: DA to lodge PAIA application to Demarcation Board

The DA will submit an application under the Promotion of Access to Information Act (PAIA) to the Municipal Demarcation Board (MDB) to require it to explain the decision to merge Midvaal with Emfuleni. This will be done in terms of section 25 of the Municipal Demarcation Act.

The MDB must be held accountable for its decisions and must explain its reasons in order to ensure that it adheres to the provisions of its own legal framework.

The DA is very skeptical about the Board’s decision to merge Midvaal with Emfuleni and believe that this decision was politically motivated. The Board now has an opportunity to dispel this belief.

It is disappointing that the MDB does not publish its reasons automatically when announcing its decisions and that a PAIA application is necessary to obtain reasons. I call on the MDB to publish its reasons for the decision because this is in the public’s interest. It must not delay doing so by hiding behind a PAIA process.

The DA hopes that the MDB will act in an accountable manner and provide the information sought as a matter of urgency. Unfortunately its track record indicates otherwise as it has not yet responded to the Midvaal municipality’s PAIA application that was submitted more than two months ago.

The DA remains committed to the process to fight the Midvaal merger until all our options have been exhausted, including going to court if necessary.
