Legislature cannot be a Safe Haven for Former HOD

The Mpumalanga Provincial Legislature cannot be a safe haven for former Human Settlements HOD, David Dube. Dube has been implicated in a damning SCOPA report, as being responsible for a variety of irregularities and maladministration within the Department of Human Settlements while he was the HOD and accounting officer of the department.

Dube, who is currently the Deputy Speaker of the Legislature, was deployed as an MPL, by the ANC, after Premier Mabuza dismissed him as HOD in March 2013. It is apparent that Dube is relying on his current position to evade being held accountable for the chaotic state of the Human Settlements Department, caused under his watchful eye.

During a SCOPA meeting yesterday, the committee discussed the draft report on the Auditor Generals findings on the Department of Human Settlements for the 2012/13 financial period. The final report will be tabled on Friday for the House to adopt.

The Auditor General found that the accounting officer (Dube) had committed several infringements (Click here for the full report).  These infringements directly contravened a range of legislative provisions, including the PFMA, the DORA, GRAP and Public Service Regulations.

Absurdly, Dube is now also a member of SCOPA, and during the meeting, he was vocal on the recommended disciplinary proceedings that the Executive Authority must take against the accounting officer – namely himself. It goes beyond comprehension how he can sit in judgement of his own conduct and he clearly hopes that the current accounting officer will be held liable for his mistakes.  The DA objects to Dube being allowed to take part in this discussion when in fact he himself was the accounting officer for that financial period.

Premier Mabuza must reveal why Accounting Officers such as Dube can be deployed from one department to the next, creating financial havoc in their wake, yet are never held liable for this financial misconduct.

The DA believes that David Dube should be prohibited from any SCOPA meetings in which the Department of Human Settlements is being discussed during the year that he was the accounting officer. In this light, the DA will be writing to the SCOPA Chairperson, Mr S.I. Malaza, insisting that David Dube not be allowed to take part in the SCOPA discussions which pertain to his tenure as accounting officer.

The DA welcomes the committee’s recommendations for the Executive Authority to take disciplinary action against the accounting officer; however, it is pertinent that Dube himself is the accounting officer who will be held accountable.

Furthermore, the DA will be writing to the Public Protector and asking that they investigate the Auditor Generals’ findings for this financial year, requesting that David Dube should be held liable in his personal capacity for the misconduct during that period.
