THE Bloemfontein High Court has today ruled in favour of the DA, forcing the NPA to reveal the record of decision behind the dropping of charges against KZN ANC politicians, MECs Peggy Nkonyeni and Mike Mabuyakhulu.
This after the pair were linked to a multi-million rand water purification scam several years ago which included allegations that they had accepted a R1 million kickback for the ANC.
Today’s court victory vindicates the DA’s long-held conviction that the record of decision to drop all charges against both parties belongs in the public domain.
It further justifies our belief that as members of the provincial cabinet, both Nkonyeni and Mabuyakhulu are accountable to the people of this province.
According to our attorneys, the order was in the following terms;
– The DPP’s decision to withhold the report requested by the DA is set aside
– The DPP’s office must furnish the report to the DA save any privileged information
– Costs are awarded to the DA including the costs of two counsel.
Today’s triumph comes after numerous attempts by the DA to have this information released, including an earlier Public Access to Information application (PAIA), which was denied.
The DA remains firmly committed to establishing the truth around this matter.
We look forward to receiving the record of decision upon which we will hand it over to our legal team for scrutiny before we announce any new steps.
